Where is gay marriage legalized in the US?

Answer: http://en.wikipedia.org/wiki/Same-sex_marriage_in_the_United_States Same-sex marriages are currently granted by five of the 50 states, one federal district, and one Indian tribe: In Connecticut, Iowa, Massachusetts, New Hampshire, Vermont, and Washington, D.C., marriages for same-sex couples are legal and currently performed. The Coquille Indian Tribe in Oregon also grants same-sex marriage. State which previously granted same-sex marriage licenses: In California, same-sex marriages were performed between June 16, 2008, and November 4, 2008, after the California Supreme Court held the statutes limiting marriage to opposite-sex couples violated the state constitution; however, the California electorate then approved California Proposition 8, a voter initiative that made the ban part of California's constitution. The California Supreme Court upheld the voter-approved constitutional ban.[1] Proposition 8 was challenged in federal court in Perry v. Schwarzenegger. On August 4, 2010, a federal judge ruled that California's ban on same-sex marriage was unconstitutional,[2] and stayed his ruling.[3][4] On August 12, 2010, he ruled that marriages could resume on August 18, 2010, but the United States Court of Appeals for the Ninth Circuit stayed the ruling pending appeal.[5][6] States which recognize same-sex marriage but have not granted same-sex marriage licenses: In New York, Rhode Island, and Maryland, same-sex marriages are recognized, but not performed.[7][8][9] The movement to obtain marriage rights and benefits for same-sex couples in the United States began in the early 1970s. The issue became even more prominent in U.S. politics in the mid-1990s with a public backlash toward the idea evidenced by Congress' passage of the 1996 Defense of Marriage Act. However, in the opening decade of the 21st century, public support for its legalization has grown considerably.[10] A poll taken between August 6 - 10, 2010 found support for allowing same-sex marriage in the United States over 50% for the first time. 52% of respondents answered the federal government should give legal recognition to marriages between couples of the same sex (46% in 2009), 46% were against (53% in 2009).[11][12] New England has since became the center of an organized push to legalize same-sex marriage in the U.S., with four of the six states comprising that region granting same-sex couples the legal right to marry. The issue remains politically divisive in the United States.

When will gay marriage be legal in the state of Illinois & in the city of Chicago?

Answer: I'm very positive that same-sex marriage will be legalized in the U.S State of Illinois & in the city of Chicago somewhere within the next 10 years possibly even somewhere within the next 2-3 years, and I say that because back on August 4th 2010 an openly-gay Judge in the U.S State of California struck down Proposition 8 that bans same-sex marriage in the U.S State of California as Unconstitutional thanks to the 14th Amendment that guarantees equal protection under the law, and if that ruling is sustained, that decision could possibly lead towards the legalization of same-sex marriage across all 50 States of the U.S.A. nation-wide. Same-sex marriages are currently granted by five of the 50 states, one federal district, and one Indian tribe: In Connecticut, Iowa, Massachusetts, New Hampshire, Vermont, and Washington, D.C., marriages for same-sex couples are legal and currently performed. The Coquille Indian Tribe in Oregon also grants same-sex marriage. The one U.S State which previously granted same-sex marriage licenses: - In the State of California, same-sex marriages were performed between June 16, 2008, and November 4, 2008, after the California Supreme Court held the statutes limiting marriage to opposite-sex couples violated the state constitution; however, the California electorate then approved California Proposition 8, a voter initiative that made the ban part of California's constitution. The California Supreme Court upheld the voter-approved constitutional ban. Proposition 8 was then challenged in federal court in Perry v. Schwarzenegger. On August 4, 2010, an openly-gay federal judge ruled that California's ban on same-sex marriage was unconstitutional, and stayed his ruling. On August 12, 2010, he ruled that marriages could resume on August 18, 2010, but then the United States Court of Appeals for the Ninth Circuit stayed the ruling pending appeal until at least December 2010, so same-sex marriages won't be performed in the U.S State of California for the first time since 2008 until at least December 2010. The U.S States which recognize same-sex marriage but have not yet granted same-sex marriage licenses are: The U.S States of New York, Rhode Island, and Maryland, same-sex marriages are recognized, but not performed in those States, just like it is in the nation of Israel. So if LGBT Rights continue to progress in the U.S.A. then sooner or later it looks like same-sex marriage will eventually be legalized nation-wide across the U.S.A. Same-sex marriage is already legal nation-wide in two countries in the american continent, because same-sex marriage was legalized nation-wide in Canada in the month of July 2005 and it was legalized nation-wide in Argentina in the month of July 2010, so who knows maybe the U.S.A. will be next country to legalize same-sex marriage nation-wide in the american continent. In July 2005 Canada became the first nation in North America and in the entire american continent to legalize same-sex marriage nation-wide, and then in July 2010 Argentina became the first nation in all of Latin America and in all of South America to legalize same-sex marriage and to even adopt same-sex marriage legislation on a nation-wide scale.

how many states allow same sex marriages?

I think there is only 2: Massachusetts and Connecticut but I am not sure if that is right.
Answer: Five perform same sex marriage: Massachusetts, Vermont, Connecticut, New Hampshire, and Iowa. Washington D.C. also performs same sex marriage. New York, Rhode Island, and Maryland recognize gay marriages from other states, but do not grant same sex marriage licenses themselves. New Jersey has legal unions essentially the same as marriage for same sex couples. California, Colorado, Hawaii, Maine, Maryland, Nevada, Oregon, Rhode Island, Wisconsin and Washington have legal unions for same-sex couples that offer some of the rights and responsibilities of marriage.

California Ban On Gay Unions Is Struck Down

LOS ANGELES -- A federal appeals court panel on Tuesday threw out a voter-approved ban on same-sex marriage passed in 2008, upholding a lower courts ruling that the ban, known as Proposition 8, violated the constitutional rights of gay men and lesbians in California. The three-judge panel issued its ruling in San Francisco, upholding a 2010 - By ADAM NAGOURNEY; John Schwartz contributed reporting from New York, and Ian Lovett from Los Angeles.

OP-ED COLUMNIST; A Brief for Justice Kennedy

THRILLING as it was to hear a sitting president endorse marriage rights for gay and lesbian Americans, there is one man whose opinion on the subject matters more than President Obamas. Justice Anthony Kennedy is the likely deciding vote when this issue reaches the Supreme Court. More than anyone, he has the power to transform what is now a license - Bill Keller Op-Ed column observes that Supreme Court Justice Anthony Kennedy will probably be the deciding vote on the issue of same-sex marriage, should two lawsuits concerning the issue reach the court; examines Kennedys past decisions in order to determine how he may rule on the issue. Can someone explain federalism and gay marriage pls?

In regards to us institution and the role of states.
Answer: The U.S. Federal government does not recognize same-sex marriage as legal or valid, no matter where the couple involved were married. This is thanks to the Defense of Marriage Act which passed Congress and was signed by President Clinton in 1996. The DOMA also gives states the right to refuse to recognize same-sex marriages entered into in another state, so if a gay or lesbian couple marries in Massachusetts, and then moves, lets say, to Texas -- the state of Texas does not (and will not) have to recognize their Massachusetts marriage license as valid. This is in contrast to heterosexual marriages, where a marriage entered into in one state is automatically recognized as legally valid in all 50 states with no questions asked. Various states have recognized same-sex marriage: Vermont, Massachusetts, New Hampshire, Connecticut, Iowa, and now New York. Washington DC also. But, as I said, these marriages are not legally recognized by the Federal government, so same-sex couples married in these states do not receive any of the Federal benefits of marriage, like the right to file joint tax returns, receive Social Security benefits from a deceased spouse, the right to sponsor a foreign-born spouse for immigration into the U.S. and about 1,000 other benefits according to the General Accounting Office.

How would you simplify the New Arizona law?

And when you simplify this new law where is the drama? I understand it to be, Everyone should be having an ID with them at all times, to show you are there legally. So when you get pulled over you should have a drivers license. Or without vehicle a id card, green card etc. If you dont have this you are breaking the law. So whats the big deal?
Answer: I'm Latino, Democrat, Gay, and I support this Arizona law! The fact is, illegal aliens have “more” rights than gay people. Illegal aliens can see their opposite sex partners in hospitals, and up until just 2 weeks ago when Obama signed an executive order allowing same-sex couples to see one another in hospitals, same sex couples would have been continually barred from seeing one another. Illegal aliens can marry an American citizen, gay people cannot marry in most states in the US. Illegal aliens can march on Washington and request some type of amnesty from a president who supports selective amnesty, gay people can march on Washington, but Obama doesn't support same sex marriage. Illegal aliens broke the law entering our country and are using their "anchor babies" (born here in the US) to anchor onto benefits that taxpayers pay for which include: public housing, free rent, food stamps, and free healthcare (when they go to emergency room, guess who pays? YOU!). Additionally, there's nothing to stop them from having more kids in order to convince a judge to let them stay in the US. On the other hand, many states don't allow gay Americans to adopt children. Illegal aliens should all be deported now. We need to end birthright citizenship, and deny illegals social services. Americans are ultimately left to pick up the bill for the billions in services they receive for free all the while paying nothing into the system and send all their earned money back to Mexico to help our their country, not ours. Citizens paying taxes into the system, regardless of sexual orientation, should come FIRST before illegal aliens who are leaving struggling Americans footing the bill. Illegal aliens are also blatantly disregarding our citizenship laws, that is, the LEGAL and the RIGHT way to enter our country and are abusing the public assistance system to their advantage. This needs to stop NOW!

What states do allow gay marriage, and what states do not?

I know my state does, otherwise my husband and I would not be married. But what do the other states say?

RULING ON SAME-SEX MARRIAGE; NEW JERSEY COURT BACKS FULL RIGHTS FOR GAY COUPLES

New Jerseys highest court ruled on Wednesday that gay couples are entitled to the same legal rights and financial benefits as heterosexual couples, but ordered the Legislature to decide whether their unions must be called marriage or could be known by another name. In a decision filled with bold and sweeping pronouncements about equality, the New - New Jersey Supreme Court rules that gay couples are entitled to same rights and benefits as heterosexual couples, but orders Legislature to decide whether their unions must be called marriage or could be known by another name; gives Legislature 180 days to expand existing laws or come up with new ones to provide gay couples benefits including tuition assistance, survivors benefits under workers compensation laws, and spousal privilege in criminal trials; court rules unanimously on rights for same-sex partners, but court splits, 4 to 3, on how to proceed, with majority saying lawmakers, not court, should decide what to call these unions; ruling, similar to one in Vermont, passes along to Legislature thorniest question, of whether true equality demands same name; three Democratic Assemblymen, working with gay rights organization, say they would introduce bill demanding marriage; reaction from their fellow legislators is guarded; decision in New Jersey is important shift from recent court rulings in New York, Washington state and California that essentially rejected gay couples claims on marriage and benefits it confers; photos (M) - By DAVID W. What are some states that DONT allow gay marriage? How do the governments of those states treat homosexuals?

Im writing a story about two teenage lesbians and I want to know what states dont allow gay marriage and how those states prosecute gays.
Answer: The only states that currently DO allow same-sex marriage are Massachusetts, Vermont, Connecticut, and Iowa. New Hampshire will begin allowing same-sex marriage starting on Jan 1, 2010. NONE of the other states allow it. Some states (New Jersey, Colorado, Hawaii, Maryland, Nevada, Oregon, Wisconsin, Washington, and the District of Colombia) offer "civil unions" or "domestic partnerships" for same-sex couples which offer some, but not all, of the rights and benefits of full marriage. Thirty states have passed amendments to their state constitutions which explicitly prohibit same-sex marriage. More than forty states explicitly restrict marriage to two persons of the opposite sex, including some of those that have created legal recognition for same-sex unions under a name other than "marriage", e.g., civil unions and domestic partnerships. Nineteen states ban any legal recognition of same-sex unions that would be equivalent to civil marriage. New York courts have ruled that same-sex marriages conducted in states where they are legal must be recognized by those states, but that the state statutes do not allow the issuance of same-sex marriage licenses — as a result New York now has same-sex divorces without allowing same-sex weddings.

I Have A Question About Same Sex Marriage?

Ive been hearing it a lot on t.v. a lot lately, so i was wondering where in the U.S. is same sex marriage legal, and where is it banner, but still they recognize gay marriages.
Answer: Only Massachusetts, Vermont, New Hampshire, Iowa, Connecticut, and Washington DC will issue same-sex couples marriage licenses. But in New York, Rhode Island, New Jersey, Maine, and Maryland, same-sex marriages are recognized from elsewhere but these places will not currently issue marriage licenses. (Several other states such as New Mexico don't have any actual written laws saying that they will recognize same-sex marriages from other jurisdictions but their state laws seem to point towards that idea. In other words, there are several other states that probably would recognize same-sex marriages from other jurisdictions if a couple challenged it in court) You can have a gay marriage ceremony anywhere in the United States (since it's a free country) but the marriage will only be able to receive licensing from the first 5 states listed plus Washington DC.

Where was gay marriage legalized in the U.S.?

Im doing an essay on gay marriage for one of my courses. I want to discuss how gay marriage momentarily recognized in Massachusetts and Hawaii, only to be overshadowed by the government not recognizing the unions as a nation. I dont have all of the details though, as in dates and terms. Any specifics that you could help me out with would be greatly appreciated. Also, is San Francisco currently trying to recognize civil unions as marriage? And have civil unions ever recieved the same tax benefits as a more traditional marriage?
Answer: Currently the only state in the US that allowes gay-marriage is Massachusetts, but not in Hawaii. Same-sex marriage in the U.S. state of Massachusetts began on May 17, 2004, as a result of the Supreme Judicial Court of Massachusetts ruling in Goodridge v. Department of Public Health that it was unconstitutional under the Massachusetts constitution to allow only heterosexual couples to marry. Massachusetts became the sixth jurisdiction in the world (after the Netherlands, Belgium, Ontario, British Columbia, and Quebec) to legalize same-sex marriage. It is the first U.S. state to make same-sex marriages legal. Hawaii has neither legalized same-sex marriage nor civil unions however the state does provide for Reciprocal Beneficiary Relationships which any two people, who are not married, can register for, including same-sex couples. In 1998, Hawaiians amended their state constitution to prevent the judicial introduction of same-sex marriage, however the constitution is silent on civil unions and does not prevent the legislature from introducing either same-sex marriage or civil unions. A bill to create civil unions is expected to be introduced to the House in March 2008. A similar bill was proposed in 2007, but was allowed to die. Marriage, as defined by the civil law, is presently available to same-sex couples in five jurisdictions. The Netherlands was the first country to allow same-sex marriage in 2001. Same-sex marriages are also recognized in Belgium, Spain, Canada and South Africa. At present, Massachusetts is the only state in the United States that allows same-sex couples to obtain marriage licenses.[11] This is the result of a 4 to 3 decision by the Massachusetts Supreme Judicial Court in Goodridge v. Department of Health, which found that the state constitution required same-sex couples be granted marriage licenses under the "common benefits" clause.[12] While there were initial efforts to limit the decision legislatively[13] or pass a state constitutional amendment reversing the decision,[14] ultimately marriage licenses began to be issued to same-sex couples. These couples enjoy all the benefits of opposite couples under state law, including the right to inherit, sue for loss of consortium, and coverage under state insurance laws. These benefits do not, however, extend to matters controlled by federal law, such as the ability to file a joint income tax return or assert a claim as a dependent spouse under Social Security. This is due to the Defense of Marriage Act, passed by Congress in 1996, which Act states, "`In determining the meaning of any Act of Congress, or of any ruling, regulation, or interpretation of the various administrative bureaus and agencies of the United States, the word `marriage' means only a legal union between one man and one woman as husband and wife, and the word `spouse' refers only to a person of the opposite sex who is a husband or a wife.'[15] While Massachusetts is the only state to issue marriage licenses to same-sex couples, several other states - including New Jersey, Connecticut, Vermont, New Hampshire, Maine, California, Oregon, Washington state, Hawaii - and Washington D.C. offer civil unions or domestic partnerships, which grant same-sex couples some or all of the same rights under state law granted to married couples. New York, Rhode Island, and New Mexico recognize foreign marriage licenses, but do not grant them or any other form of same-sex relationship recognition. Twenty six states have amended their constitution to define marriage as the union of a man and a woman, with the language varying as to what legal rights, other than marriage, can be extended to same-sex couples Israel's High Court of Justice ruled to recognize same-sex marriages performed in other countries, although it is still illegal to perform them within the country. A bill was raised in Knesset to rescind the Israeli High Court's ruling, but the Knesset has not advanced the bill since December 2006. Canada and Spain are the only countries where the legal status of same-sex marriage is exactly the same as that of opposite-sex marriage, though South Africa is due to fully harmonize its marriage laws. Other nations all have requirements or restrictions that apply to same-sex marriage that do not apply to opposite-sex marriage. Also, try to talk to a librarian in order to get more infomation about this issue, either a librarian at a public library or at a university's library, or any other library.

Is gay marriage illegal to have in the state of Louisiana?

Please no homophobic answers. I am 19 and Im an openly homosexual male. I have a boyfriend who is 23 and we just got engaged last night to marry each other. I love my boyfriend very much but him and I were wondering if we are allowed to marry in this state since some states do prohibit gay marriage. We live in Louisiana. Can we get married in this state? if so then great but if not, what states allow you to have a gay couple wedding.
Answer: You can get married anywhere in the US but it won't be recognized by most states (including Louisiana). The only places that will grant gay marriage licenses in the U.S. are Washington DC, Massachusetts, Vermont, Connecticut, New Hampshire, and Iowa. New York, New Jersey, Maryland, and Rhode Island do not give same-sex marriage licenses but they do recognize same-sex marriage licenses from elsewhere. But you can certainly hold a ceremony in Louisiana if you want, but in the US, you could only get a marriage license in the 5 states priorly mentioned plus Washington DC.

How many states have legalized gay marriage?

Answer: The United States In the United States gays and lesbians can legally marry in Massachusetts, Connecticut, Iowa, Vermont (beginning September 1, 2009) and Maine (beginning mid-September 2009). New Hampshire Governor John Lynch has said he will sign legislation to legalize same-sex marriage there, as long as steps are taken to protect religious institutions. New York recognizes marriages by same-sex couples legally performed elsewhere. •With the passage of Prop 8, gay marriage is no longer an option in California. United States: •Connecticut: As of October 1, 2005, gays and lesbians are able to enter into Civil Unions in Connecticut. Civil Unions will give gay and lesbian couples many of the same rights and responsibilities of marriage. Civil Unions are only available to same-sex couples. •In Vermont you can get a Civil Union. In 2000, Vermont legislature passed and Governor Howard Dean signed a law creating civil unions for same-sex couples, giving these couples all the rights and benefits of marriage under Vermont law but not marriage licenses. •New Jersey: On December 14, 2006 the New jersey legislature approved a bill allowing same-sex civil unions. Civil Unions became available in New Jersey in February 2007. •California: Gay and lesbian couples can register as domestic partners in California. Couples who register are eligible for many of the same state rights as heterosexual married couples, but only in the state of California. The rights of civil unions do not transfer from state to state like marriage does. •Hawaii offers reciprocal beneficiary rights to same-sex couples. Some of the rights granted are: inheritance without a will, ability to sue for the wrongful death, hospital visitation and health care decisions. •Maine instituted a domestic partner registry in 2004. Maine's law mostly benefits couples if one dies: inheritance without a will, the right to make funeral arrangements and the ability to be named guardian if partner becomes incapacitated. •Washington State offers some of the rights of marriage via domestic partnerships. The law takes effect July 22, 2007. •New Hampshire offers civil unions to gays and lesbians beginning January 2008. •Oregon offers a comprehensive domestic partnership law that offers all the state benefits of marriage.

Do you agree with and support the new Arizona Immigration Law?

Please give your answer and opinion. My opinion is that it is undeniable that immigration reform is desperately needed, and I fully support strict immigration reform. However, after reading the provisions in this law, it does appear to me that law enforcement agents are encouraged to racial profiling individuals. For example the law requires the police attempt to determine a persons legal status, if it is suspected an individual is an illegal immigrant. Well, how would they suspect ones legal status without becoming suspicious of ones skin color? Police maybe detain a person without a warrant if the person cannot provide the necessary documentation. Here is where you enter a very grey area, someone who is a Hispanic US citizen and accidentally leaves their wallet at home can be arrested just because he is brown. This is very very wrong and the reason why I do not support this particular bill. The people that support the bill need to put themselves in that position. Imagine if you were a US citizen, but you forgot your wallet at home and could not prove your citizenship at that very moment and you were arrested for it. Im assuming you would not care for that to much. This concerns me so much because I am a Hispanic-American, and say I was staying in Arizona and left my wallet in my hotel room, I would be horrified if I was detained just because Im brown and without a wallet. Please note that I am not referring to driving without a license which is illegal for different reasons. I am referring to an individual who is walking down the street and unable to provide identification. I too agree that illegal immigration is a major problem in this country. However, that is not what I am asking. I am asking whether or not you support the Arizona law that seems to condone racial profiling.
Answer: I'm Latino, Democrat, Gay, and I support this Arizona law! The fact is, illegal aliens have “more” rights than gay people.
