Today my mom was taking about how gay marriage is bad and how it threatens society and honestly i dont think it does. To me i dont see how to people of the same sex getting will hurt anyone and how having 2 moms or 2 dads is wrong. To me a family is family
Answer: You are correct. Ask your mom if it harms her. Does it cost her money? Does she have to participate in a gay marriage? Will it affect her health? Of course, it won't. Ask her how it affects anyone else. The only impact it has is to offend some people's delicate sensibilities, and there is not constitutional right to not be offended. Also, as her to substitute the word "interracial marriage" for gay marriage and tell you what the difference is. I think it's funny when people say "a marriage is between a man and a woman so gay marriage isn't possible". I suppose they've never heard of semantics. I can't see the supreme court knocking down the lower court decision in CA. It will be the law of the land in a matter of years, if not months

Answer: It's only true for the ones who married after the California Supreme Court took it upon itself to say the law that said they couldn't was unconstitutional according to the CA constitution. Now, the CA constitution has been amended, so they cannot marry. Polygamists still cannot. Siblings and whatever other familial relationships California has designated still cannot. Answer: The mormons poured millions into forcing through prop 8 in CA: to ban gay marriage. In August 2010 the court held that to be unconstitutional. On 15 June 2011 the San Francisco court upheld that decision because it violates the constitutional rights of citizens. It is now awaiting the Supreme Court verdict e which is expected to uphold the early court decision. If that happens then gay marriage will become legal everywhere! Does not allowing same sex marriage violate peoples Constitutional rights?

If the Supreme Court considered the same sex marriage issue, and fully examined it in terms of the US Constituation, what do you think they would say?
Answer: Depends on how you look at it. gay right advocates say it violates the establishment cause which states that the government is prohibited from establishing religion. gay people are saying that the gov't is establishing a religion by not allowing them to marry by basing their beliefs on judeo-christianity. If you take a look at the constitution and the bibles 10 commandments you will see alot of similarities. Take a look yourself. Another arguement is equal protection (14th amend.) this law states that marriage is a fundamental right. (obviously not for gays though) since they are being denied. research it you will be surprised at what you find.

What will happen if the US Supreme Court overturns Prop 8?

That would mean that same-sex marriage would be legal throughout the country? Im not too knowledgeable when it comes to the American justice system, and I was just curious. Id like a serious response, please.
Answer: It depends on what the Supreme Court decides. If they tackle the issue head on and find that it is unconstitutional to ban gay marriage, and there is some reason to think they will do that, then all laws anywhere in the Country, not just California, that ban gay marriage would be thrown out. There would likely be a few additional lawsuits concerning enforcement, especially among States that have no specific law on the books either way but don't currently recognize gay marriage and the likely outcome would be a declaration that marriage is marriage and the States cannot discriminate on the basis of sexual orientation when allowing people to enter that institution. So within a pretty short time, if the Supreme Court overturns Prop 8, gay marriage would be legal everywhere in the US. However, the Supreme Court is notorious for finding ways to punt on major issues. I don't know if they will do that here, as it is clear that the split decisions all over the country are calling out for a single decision, but they may find a way to rule on this specific case without saying anything significant about the laws in other States. If they do that, there will be other lawsuits that would follow (which is one reason they may take on the issue directly with this case). Note that if they decide in favor of Prop 8, it won't change gay marriage laws anywhere, it would only mean that it is not unconstitutional to prohibit gay marriage. It wouldn't mean that State's can't permit it.

Will same-sex marriage have to be recognized by all 50 states if the Supreme Court chooses not to hear the?

cases in which the lower courts have ruled DOMA unconstitutional? Does that mean that their rulings will stand, DOMA will be unconstitutional, and every state will have to recognize same-sex marriages, even if they dont legalize them in their state?
Answer: I think you should take a look at Loving v. Virginia, that legalized the analogous issue of interracial marriage. The reason that Loving v. Virginia passed, is that there were criminal penalties to be imposed by Virginia on the Loving couple, just because they were mixed races. It was the activity that Virginia wanted to punish, rather than the status of a marriage under the law. These criminal penalties are what is most wrong about anti-miscengenation laws, and what are always wrong about any anti-consensual sex law. It was the DUTY of the Supreme Court to keep this couple out of prison. Thanks to Lawrence v. Texas, there will not be criminal penalties due to any noncommercial consensual sex between adults, even if same sex. This means, that a SCOTUS court ruling for gay marriage doesn't have the purpose of eliminating a criminalization like it did for Loving v. VA. Why are Christians so opposed to same-sex marriage in particular?

Even if same-sex marriage is against Christian doctrine, isnt it a secular nation? And arent birth control and pre-marital sex against Christian doctrine too, yet there arent any laws against birth control or having pre-marital sex? It just seems like a religious question that shouldnt even be a problem in the secular government. I was unaware of the law in Mississippi, I live in the northeast and that seems very odd to me. All marriages performed in the capital must be recognized by all the states. (Its the law) And today on the news i saw that three gay couples were attempting to get married in the state of oaxaca. Is it fair to compare gay marriage to miscegenation, which was once illegal in several states before the ?

Supreme Court deemed it unconstitutional?
Answer: There are fundamental rights guaranteed by the Amendments to the Constitution at stake here! If we took the government out of the "marriage" business altogether, could we come to a meeting of the minds on both sides? Make it so the government couldn't marry at all. The Justice of the Peace could only issue Civil Unions, regardless of sexual orientation. Give the terms "marriage" and "matrimony" to the churches exclusively. Require everyone to be civilly united (so the govt. can still get it's palm greased) and strike the terms "marriage" and "matrimony" from our codes. In other words, give marriage no legal standing and treat it as a religious rite or sacrament. There are several churches here, where I live, that will marry same-sex couples, and I say fine, it's up to them. The amendments added to the Constitution in the 1860s guaranty equal rights to black Americans, but it doesn't take a Constitutional lawyer to extrapolate equal rights for all from within those lines. My concern is that a same-sex couple might chose to bring the courts to bear on churches that refuse to marry them citing the California Supreme Court ruling. I see government involvement here as a violation of another fundamental right. The first Amendment clearly states "Congress shall make no law respecting an establishment of religion, or prohibit the free exercise thereof..." I don't belong to a church, but I believe my right to "think" and "believe" as I wish is grounded in the freedom-of-religion part of the 1st Amendment. Changing it or overriding it is nothing less than government initiated thought control, and I am squarely against government thought control. If you remember from history class, it's why a good many of the original settlers came to America! This is why the very first issue addressed in the very first amendment, the start of the Bill of Rights, is freedom to think and believe as we wish, without government intervention. I am not emotionally involved in this issue but I see each side and they both find grounding in the Constitution in my opinion. When the court in California ruled that gay marriage is legal, the separation clause in the First Amendment was likely to be challenged. Now that a majority of Californians voted for an amendment to the state constitution naming marriage as between a man and a woman, the right to equality of same-sex couples has been violated. (This all happened very quickly by the way, with the court ruling on May 15, and the ballot initiative going to vote Nov. 4--less than 5 months.) I'm just saying that now that both sides' noses have been bloodied, maybe it's an oportunity for everyone to take a step back and see if something can be worked out to satisfy both. So here's the challenge as I see it: 1. Protect the rights of same-sex couples, which prop 8 fails to do 2. Protect the sanctity of a given church's doctrine from judges that would place our First Amendment rights dangerously close to the brink So finally, to answer your question directly, there is no civil distinction in my mind. The civil argument for same-sex marriage and miscegenation are the same. You would have to talk to the individual churches regarding their specific doctrine to draw distinctions. I might add, if you don't like the way your church treats this issue, you can certainly take it up with them, and their other members, if you happen to go to church. If we take government out of the "marriage" business, we satisfy Brown v. B of E don't we? All are equal under the law. Existing relationships would have to be grandfathered to avoid a horrendous mess, but any new coupling could be made under Civil Union. Catholics, for example, could still hold matrimony as santimonious and different from a civil union just like babtism and confirmation, which hold no civil standing. Hospitals, insurance companies, etc. would all have to re-write their rules for all people who are united, putting an end to discrimination, hopefully. Would this work for you? We always have to try to find ways to satisfy the needs of the few without violating the needs of others, don't we? Isn't that what a Democratic Republic is all about? EDIT caliguy_30: Your assertion that "forefathers and lawmakers never ever thought that such immoral act as marrying someone of the same sex could ever be possible" is inaccurate in my estimation. They [forefathers] were mostly educated men, Adams a Harvard graduate, Jefferson hailed from William and Mary, etc. Surely they would have known that the Roman Empire, while not getting involved in the function of marriage, did find it necessary to make a law prohibiting same-sex marriage. I don't know the Roman's reasoning, and I can't find the law in a quick Google search, but if you want to dig through the Corpus Juris, I'm sure you'll find it. Point being, it may have been an oversight, but it may have been something else. I don't really know, but I don't buy the senario that they never dreamed in a million years... Also, I've had gay friends my entire adult life, and gay clients for nearly as long. I've never gotten the impression that any of them are trying to "impose their ways and views" on me. How would legal recognition of same sex marriage work in relation to religious celebrants?

Would it mean that a priest for example, be legally obliged to officiate a marriage or would the couple have to find a civil celebrant?
Answer: Canada has same-sex marriage across the entire country. But, no clergy are obliged to perform the ceremonies. The Freedom of religion provisions in law triumphs that law - the new law was written that way. There is an unsettling matter of marriage commissioners though. Some have refused to perform same-sex marriages, based upon their own religious convictions, and, have been fired. I am not sure if any have taking these firings to court; my sense is that the firing would be overturned, but, as far as I know, this has not been tested yet, at least not at the Supreme Court of Canada level.

What happens if the Supreme Court says NO to same-sex marriage?

I know were not there yet, but what ever the out come is of the current trial in CA it will eventually end up in Supreme Court. Well it just made me wonder, what happens if the Supreme Court rejects same sex marriage. There is no court higher than that, so no more appeals right?
Answer: If they refuse to overturn Proposition 8, then things will remain status-quo, as they are. States will still have the right to have same-sex marriages if they wish. But same sex marriage would not be required. However, should the Supreme Court overturn Proposition 8, there is a possibility they could mandate same-sex marriage across the country. Personally I doubt if they will do that, though I wish they would. However, new cases are continually brought up before the High Court, and it takes a long time before anything is set in stone. Regardless of what happens, I predict LGBT will have to work politically for a generation to ensure our equal rights.

Answer: I agree. I live near san Francisco and the news is crawling all over every action they take like maggots. It's all the time and I'm really, really sick of it. There's some SF lawyer who keeps saying that our society is being "watered down" to the point where "all of the Christians who are voting against it will die off" and that the "new generations" will eventually vote it in. He's a moron...it's not only Christians who are against this. There are very liberal people with gay family members who are against this law passing because it changes a tradition that we ALL value for the pleasures of a small group. Hopefully, it will never be over turned. I mean, come on...the people voted on it, that should be the end of it. But with the social derelicts like this loud mouthed lawyer constantly stirring it up, there's no hope of peace and acceptance of the peoples voice. You can't even go to a restaraunt or show anymore withou being harrassed by these angry gays, screaming and carrying signs. And these are people who want to be taken seriously???? You dont get what you want by bullying people. Well - I shouldn't probably say that. Obama got elected that way....I guess they think that if it worked for Obama, it would work for them. I think they will rule in favor of it and what leads me to this conclusion is how they ruled on Lawrence v. Texas and Loving v Virginia but what do you think now that it is out of California supreme court?
Answer: I don't think they'll take the case and the lower court ruling will stand. Kennedy is the swing vote, and he loves a well reasoned decision based on the constitution, which is what Wagner's decision was. Scalia, Roberts and Alito know which way the wind is blowing, and know how Kennedy will swing, to rather than lose face, they won't take it. IMHO.
