How long would it take for something to get to Supreme Court?
My friend and I are having an argument. We are both gay marriage supporters but I think that it will be at least 4 years before Prop 8 can be overturned (the next CA election). She thinks that it will get to the Supreme Court and they will overturn it first.

Answer: In all reality, it could take quite along time. Unless it is an emergency, the court is not likely to hear it anytime soon. Often the cases I research take 6, 8, 10 even 12 years to get there, and then they often just get remanded back down for clarification or for the final judgment.
Citations are asking for a lot (not trying to be rude, but the people who have the ability to provide those, don't have the time to dig them up for you for free), but you can go to www.oyez.org it is my starting point when researching a case with Constitutional implications. Check some of the cases out and look at the facts- that will tell you when they originally went to court, and then look at the date of when it came before the supreme court, usually not the same year if you know what I mean.
Good luck, I don't think there shoulld be any question that homosexuals should be able to enjoy the same as the rest of us.

If SCOTUS were to rule gay marriage bans unconstitutional, would it invalidate bans in state constitutions?
Nevada has such a ban as an amendment to its state constitution.
Would a U.S. Supreme Court ruling invalidate gay marriage bans that are part of state constitutions, or only ones that are regular law?
Answer: Each subject and ruling has to be applied carefully. There is no true Federal law banning gay marriages completely. Marriage is a State administered item. There is federal law concerning the interstate which would say a marriage in Kentucky is valid in Ohio. The ban is for federal forms, programs, taxes, etc and does not apply within a state. It does also restrict the requirement of recognizing out of State marriages.
Now, Nevada can keep a position by law or constitution that marriages cannot be performed. They could also keep a position about state taxes and benefits and other state related items. But, if the federal law is overturned, Nevada would probably be required to recognize a marriage from Massachusetts for example. And that is what gets tricky. Depending on the extent of the ruling, it can force Nevada into a constitutional change, not to allow the ceremonies or registration, but to accept out-of-state gay marriages and that would be interesting in the courts here.
This is the way I see it.
If the ruling was strong enough, it could force a constitution change even to perform marriage, but that is rare. The Federal laws take precedence, and the Nevada courts and legislature could get their hands tied.

When will gay marriage go to the supreme court?
Some states allow it, others dont. Some (california) vote to ban it, gay activist judges overturn the majority vote of the people. Why doesnt the supreme court rule on this, and determine whether or not it is or isnt discriminatory, and whether states have a right to ban it or not.

Answer: Although it is very difficult to get the supreme court to accept a case (because of volume sent to them and they are sometimes weary to take on certain issues because they have the last word), I wouldn't be surprised if they did take on the issue in the near future. They have taken issues like school segregation (Brown v. Board of Education) and abortion (Roe v. Wade), so I hope they do address and legalize gay marriage for equality reasons. But politics also plays a role. 5 of the 9 supreme court justices are more conservative, which is probably making liberals hesitant to bring the issue to the supreme court. And it takes a long time to develop a strong case to bring to the justices.

Answer: I'm all for same-sex marriages.
The same-sex-marriage case only gets stronger and stronger with every step it takes on its way to the Supreme Court. That is why Judge Walker's looong and carefully well explained ruling is so important. It is easy for anyone (the people) to say "it's wrong (or immoral) so let's block it" but every time the issue is put to the courts and has to endure the hard scrutiny of a legal fight... well... the people against same-sex marriages have less and less to hang on to.
ALL of the reasons behind Prop 8 (that seemed so evident to so many people) DID NOT survive a trial. On the other hand, all the evidence (scientific and verifiable evidence) provided by the people fighting against Prop 8 EASILY destroyed any argumentation in favor of Prop 8.
So the issue will be dragged through every step and will get stronger and stronger... and by the time it reaches the Supreme Court, it will be unstoppable - making the case against same-sex marriage virtually impossible to argue.
Judge Walker's ruling is historical and everyone should read it. It strikes down (one by one) each and every thought behind Prop 8. And he did it in a way that is clear and beyond any doubt.

I personally think it is great that the judge was able to see that the ban on gay marriage was wrong and unconstitutional. I hope it goes to the supreme court so that these religious assholes can be put in their place.

Answer: I live in southern California and i thinks its awesome . This really hits home for me because I am a straight male with four kids . However I have a grandmother that is gay and some friends and I believe love is lveo gay ort straight and its shame that people hear gay and think it has to do with homosexual sex in the bedroom . It has to do with energy and how a person feel ,I mean come on if my kids came to me and said they were gay and wanted to mary their lover it would crush me if they couldnt do that . We as humans have no right to take away someone's personal preferance or feelings . The problem is society see's sexuality with gayity and really there are two different things .

Answer: The LGBT groups that are calling this unwise are correct. The California Supreme Court ruled on a California law, and even though many people (including me) don't like it, it does make more sense to say that prop 8 is an amendment, not a revision.
I'm guessing that the federal courts will either refuse to hear the case, or uphold prop 8. It won't harm the cause much, because prop 8 can be repealed in 2010.

Legal experts said the case could easily end with a politically conservative panel of the 9th Circuit reinstating the marriage ban and the U.S. Supreme Court refusing to get involved.
Even though the court is known as a liberal one, the 27 active judges sitting on the court represent every conceivable point along the political spectrum. Its judges are drawn from the nine western states where its decisions are law.
"Everything depends on which 9th circuit judges get picked randomly to sit on the case," said University of California, Davis law professor Vikram Amar.
Amar said that the nationwide debate over gay marriage shows just how unsettled the issue is and that conservative judges hew closer to keeping the status quo than taking large legal leaps to rule in favor of significant social change. He noted that 44 states dont allow gay marriages.
"Its easy to imagine the court wanting to make sure were not rushing ahead with an experiment that may have unintended consequences," Amar said. "They could be content to let the issue percolate longer."
The liberal gay judge who wrote a 135 page brief, supporting his desire to marry his bed fellow was a bias liberal act. The 9th circuit reprsents 9 western states which none have gay marriages. the court is neither liberal or conservative, it is a matter of what 3 judges are picked.

How do you think the SCOTUS would rule on Gay Marriage?
Since gay marriage was banned in California by Prop 8, the courts have repeatedly been smacking down Prop 8 and its appeals to get it reinstated. If the appeals to have it reinstated keep going, eventually itll make its way to the Supreme Court.
I think itll be a 9-0 ruling in favour of gay marriage, since the only argument against gay marriage is a religious one. Separation of church & state has legal precedence.
Answer: In my opinion, it will be far from a unanimous decision. The conservatives on the court will likely rule that the definition of marriage is a state's rights issue since marriage isn't defined in the Constitution. The liberals on the court will likely rule that the equal protection clause of the 14th Amendment bans any form of discrimination and that gay marriage should be allowed. If SCOTUS takes up the issue with the current justices, Kennedy would probably cast the deciding vote.

How far away is Iowa from legalizing gay marriage?
Theres a court case going on there that has been in progress for 3 years already and they say it might take another year to get a ruling.

Answer: Iowa's Supreme Court heard the court arguments in December, 2008 so the ruling should happen sometime in 2009.
Court cases being heard on appeal can take some time, especially if they may set a new precedent, due to the time to prepare the legal briefs as well as amicus curiae (friend of the court) briefs from interested parties that may support one side or the other.

Was that phrased kinda weird? Anyway, the supreme court of california heard arguments for and against gay marriage today. What do you truly think the decision will be?
Answer: It will be a split decision no matter how they decide. After reading a semi-transcript of the proceedings I really think they will have to either break new ground for the court, bite the bullet and rule in favor of gay marriage or pass on it completely saying it is up to the electorate.
The California Supreme Court has always been a leader in setting nation wide precedent so I truly look to them to take the lead and find in favor of gay marriage.
What would be even better would be redefining the term marriage as a religious action/blessings and create state authorized "contracts of union" where any two people can be joined in a relationship sanctioned by the state which includes all of the present rights and privileges of the currently recognized term marriage without all the religious overtones.
Now that would be a real B buster for the religious fundies that do not recognize the meaning of seperation of state and church.

When blacks were allowed in schools and desegregated, the voters werent allowed to vote if they wanted them to remain that way or stay. If they were, desegregation would of never happend. How is gay marriage a threat to society?
Today my mom was taking about how gay marriage is bad and how it threatens society and honestly i dont think it does. To me i dont see how to people of the same sex getting will hurt anyone and how having 2 moms or 2 dads is wrong. To me a family is family
Answer: You are correct. Ask your mom if it harms her. Does it cost her money? Does she have to participate in a gay marriage? Will it affect her health? Of course, it won't. Ask her how it affects anyone else.
The only impact it has is to offend some people's delicate sensibilities, and there is not constitutional right to not be offended.
Also, as her to substitute the word "interracial marriage" for gay marriage and tell you what the difference is.

And today on the news i saw that three gay couples were attempting to get married in the state of oaxaca. However they were denied by the state. This was taken to the supreme court which ruled that it was a violation of the constitution to deny marriage to gay couples.
Now all the states must allow gays marriage.

Should it be the presidents job to decide on gay marriage?
Me, I dont think so. Its kinda ridiculous that the president should even be required to spend time on it. A presidents job should (or time, rather) should be spent on the economy, eliminating corruption, rather or not to go to war, the defense of the country, examining what laws to pass to make this country stronger, going after and stopping terrorists. Stuff like that. Leave the issue of gay marriage to the Supreme Court. A president (right now Obama) has no buiseness deciding yea or nay on gay marriage.
Answer: No, of Course not, However In this politically correct climate that relinquishes morality to the relativistic whims of society, stating that homosexuals should not marry is becoming unpopular. Should a woman be allowed to marry another woman? Should a man be allowed to marry another man? Should they be given legal protection and special rights to practice their homosexuality? No, they should not.
The Bible, of course, condemns homosexuality. It takes no leap of logic to discern that homosexual marriage is also condemned. But our society does not rely on the Bible for its moral truth. Instead, it relies on humanistic and relativistic morals upon which it builds its ethical structure.
Homosexuality is not natural. Just look at the male and female bodies. They are obviously designed to couple. The natural design is apparent. It is not natural to couple male with male and female with female. It would be like trying to fit two screws together or two nuts together and then say, "See, its natural for them to go together."
Homosexuals argue that homosexuality is natural since it occurs in the animal world. But this is problematic. It is true that this behavior occurs in the animal kingdom, but it is also true that we see animals eating their prey alive and even their own young. We see savagery, cruelty, and extreme brutality. Yet, we do not condone such behavior in our own society. Proponents of the natural order argument should not pick-and-choose the situations that best fit their agendas. They should be consistent and not compare us to animals. We are not animals. We are made in God's image.
