Video shows beheading of American captive

A gruesome videotape posted on an Islamic militant Web site Tuesday showed the beheading of an American contractor who had been looking for work in Iraq — a bloody scene that appears to mark the first violent response to U.S. abuse of Iraqi captives at Baghdad's Abu Ghraib prison.
The American in the video identifies himself as Nick Berg, 26, from the Philadelphia area before an assailant decapitates him.

Despite claims from his family, the young American who was decapitated on a videotape posted by an al-Qaeda-linked Web site was never under U.S. custody, coalition spokesman Dan Senor said Wednesday.
Senor told reporters that Nick Berg, 26, a freelance telecommunications contractor from West Chester, Pa., was detained by Iraqi police in Mosul. The Iraqis informed the Americans, and the FBI met with Berg three times to determine what he was doing in Iraq.
Senor said that to his knowledge, "he (Berg) was at no time under the jurisdiction or detention of coalition forces."
In a grainy execution video eerily similar to one in 2002 that showed al-Qaeda operatives executing a Wall Street Journal reporter in Pakistan, Berg was shown sitting in an orange jumpsuit in front of five armed, hooded men.
Berg's body was found on a highway overpass in Baghdad on Saturday.
One of the men behind Berg in the video read a statement that referred to the "satanic degradation" of Iraqi prisoners and said: "For the mothers and wives of American soldiers, we tell you that we offered the U.S. administration to exchange this hostage for some of the detainees in Abu Ghraib, and they refused. Coffins will be arriving to you one after the other, slaughtered just like this." (Related item: Video excerpt)
Berg then was pushed to the floor and screamed as one of the executioners wielded a large knife. The man sawed off Berg's head while the other captors shouted: "Allahu Akbar!" Arabic for "God is great."
The videotape bore the title, "Abu Musab al-Zarqawi shown slaughtering an American." It was unclear whether al-Zarqawi, a Jordanian lieutenant of Osama bin Laden, was in the video or was claiming responsibility for the execution. CNN reported late Tuesday that technicians familiar with his voice doubted that it was al-Zarqawi on the tape.

"My name is Nick Berg, my father's name is Michael, my mother's name is Suzanne. I have a brother and sister, David and Sara. I live in Philadelphia."
Outside their home in West Chester, Pa., a suburb of Philadelphia, Berg's father, brother and sister collapsed after reporters told them about the tape. The family, which had a photograph of Nick Berg taped to their mailbox, had been told by the State Department on Monday that Berg's beheaded body had been found. (Related story: Berg family mourns)
On Tuesday, they were stunned to learn that, thanks to modern technology, his death essentially had been a public execution. And they were angry at the Bush administration because Nick Berg had planned to leave Iraq at the end of March, but was detained by U.S. officials for nearly two weeks after being stopped by Iraqi police at a checkpoint. It's unclear why U.S. officials detained him for so long.
Besides being a human tragedy, Berg's death represents an ominous development for the Bush administration, which already is struggling to deal with the disastrous impact the prison scandal has had on America's image around the globe. With the administration trying to curb attacks by insurgents before the June 30 handover to a caretaker Iraqi government, the specter now is of terrorists ratcheting up the violence.
Privately, Army officers have expressed concern that American soldiers across Iraq might pay a deadly price for the shocking images from Abu Ghraib of Arab men being humiliated and abused by U.S. military police.
Berg's execution is "a particularly gruesome and graphic way" for terrorists to "get their point across that they will kill any American they can find," says Gregory Gause, director of Middle East studies at the University of Vermont. "My fear is that this awful act will lend credence to people in this country who say that whatever we do, others do worse."
On a day that was headlined by a Senate hearing on the prison-abuse scandal, the White House cast the Berg video as symbolic of the evil the administration faces in fighting terrorism.
"It shows the true nature of the enemies of freedom," White House spokesman Scott McClellan said. "They have no regard for the lives of innocent men, women and children. We will pursue those who are responsible and bring them to justice."
Berg's death is likely to increase concern among some Americans about the U.S. mission in Iraq, several foreign policy and media analysts said.

Is there any way to get an assault charges withdrawn?
My brother had an argument with his girlfriends mother. He lost his temper and pushed the mother. She fell and was taken to hospital just for precaution as shes over 70 years old. Luckily theres no injuries. My brother normally is a very nice person and he treats his girlfriend very nice but his girlfriends mother is against them being a couple. Nevertheless, they understood he didnt mean it. He just lost it. So, they didnt want to file any charges. However, someone else saw the incident and called the police. Apparently, the assault charges cant be withdrawn even though his girlfriends family has no intention to press any charges. My brother was taken to a police station for a few hours and then was released. A court date is to be set. I am just wondering is there any way the charges can be withdrawn? If not, what kind of punishments can happen? Is it better that we find an attorney for him? Please help. He never gets into any trouble. We really dont know what to do and what will happen. We hope this wont leave him a criminal record.

Answer: YES, get an attorney!
This will probably be charged as a battery (or assault) / domestic violence (if your brother ever lived in the same house as his girlfriend). Also, most states enhance the penalty for a battery if the victim is elderly (usually "over 60 years old") to make it a gross (or aggravated) misdemeanor, or even a felony.
Only the prosecutor can decide to dismiss the charges, and many states have laws that REQUIRE a prosecutor to prosecute all domestic violence cases unless they have actual proof problems with the case (i.e., no stopping the train just because the victims change their minds).
Who is the other witness? Did they fill out a statement? Their testimony is going to be critical to the State's case against your brother. This extra witness is a huge problem -- usually in these cases, if the victims don't show up, the DA dismisses the case, but in your situation, they have independent proof of the charges.
Your best bet for beating the charge is to hire a criminal defense attorney immediately, and then have everyone in for a consultation (including the girlfriend's mother). Tell everyone NOT to speak to the police (although I doubt that they'll bother with any further investigation), and NOT speak to the prosecutor, or to anyone from the prosecutor's office. Tell your brother not to speak to anyone in jail about the incident, and do NOT speak about the incident with him over the jail phone -- in almost all jails, the phone calls are recorded and automatically forwarded to the DA's office.
The criminal defense attorney will be able to tell you a few extra things that you can do (in this situation where the victim doesn't want to prosecute) that will make the chances excellent that the case against your brother cannot be prosecuted successfully. This will cost you a few thousand dollars, but it will be worth it for your brother not to have the record.
Possible punishment if he is convicted: In most states, battery (or assault) / domestic violence is a misdemeanor that carries a maximum of 6 months in jail. In reality, a first offender will usually receive only a few days in jail, plus community service, about $1000 in fines, violence management classes, and a suspended sentence. However, if you are charged with a second domestic violence, the penalties go up considerably. Your brother's case is also different because of the victim's age -- since she's elderly, the crime might be a gross (or aggravated) misdemeanor with a 12-month possible jail sentence, or worse, it could be treated as a felony, which carries a sentence of at least a year not in jail, but in prison.
Now, in any event, I doubt that your brother is actually going to do any real time (not more than a week). Even if he were charged and convicted of the felony, the judge would give him probation due to his lack of a prior record and the fact that the offense (shoving) is not really that egregious. But your brother does not want to be a felon -- it will ruin his life (very hard to get jobs, can't vote or hold public office, etc.). Plus, if he ever gets in trouble with the law again, police will treat him far differently if he has a record.
He's lucky that the victim doesn't want to see him prosecuted. Get an attorney pronto and take advantage of that fact -- it's worth the money to keep his record clean.

My brother was arrested for Domestic Assault in Wal-Mart parking lot . The officer that arrived on scene called my husband (we live in a small town) and told him that my brother grabbed his girlfriend by the back of her hair and drug her out of the store through her to the ground and started beating her and said he had seen it on video to prove it. Me, my husband, my brothers boss, our mom ,and our brother believed he had done this because a cop had said he seen the video showing what my brother had done. Well then three officers arrived on the scene and the arriving officer told those officers and those officers told other officers the story and they are telling other people like my brothers friends, co workers, and my brothers boss so he lost his job. He got out of jail because there was no video evidence to support the charges and he was released and the charge was dropped to simple assault because he did push her. We went to the police station and got the official police report, The only thing it says (as far as the assault) is that he pushed her through the wal-mart doors and she fell to the ground. She got up and went into the store and he left the area video confirmed the assault (Him pushing her). The city officers are telling everyone he beat her. Does he sue the police station for defamation of character or the City, What kind of lawsuit should he sue

Answer: He has no basis for a lawsuit. He has no hope of getting any money. And if he tries to file a lawsuit against the city, then the city will file a counter claim against him for filing a frivolous lawsuit and he will likely be ordered to pay the city's legal fees.
Your brother's problem is that he is GUILTY of domestic violence. He physically assaulted his girlfriend. He did it in a public place. And he did it in front of witnesses.
The word "beat" is subjective. The officers may very well use the word "beat" to describe any domestic abuse situation. They may very well use the word "beat" any time they are referring to an assault.
As far as what the officer allegedly said to your husband: That officer did not pull that account out of his rear end. He received that information from a third party and he relayed that information.
To prove defamation, you have to prove that the person deliberately, intentionally and maliciously lied about the victim for the specific purpose of ruining the victim's relationship.
If the person had a good faith basis to believe the story was true, there is no actionable defamation. Here, your brother committed an act of domestic assault against his girlfriend. There is a good faith basis to believe he is a batterer. Based on your description of what he did, I wouldn't disagree with the statement that he beat her. (A shove in front of a video camera and out in public makes me wonder what he would do in private.)
No jury would award your brother a penny. Juries simply do not like guys who put their hands on women.

During the altercation, I LANDED ON MY RIGHT KNEE and RECEIVED A SMALL ABRASION FROM THE ASPHALT. The suspect was then placed into the back of my partners patrol car where he appeared to calm down-( in other words, sober up. This is where I began to get my memory back. Up until this point, I dont remember anything)- ***** County Fire Rescue Station ** responded.... and transported the suspect to...... The suspect did not sustain any injuries from the confrontation. -(I did receive some pretty nasty road rash on my right shoulder from when they threw me to the ground, in handcuffs, but didnt notice it until I was in jail, sober. My sister and I are good friends and havent gotten physical with each other since we were kids, you know typical sibling kid stuff. She told me she isnt pressing charges btw. I think underage drinking and resisting w/o violence would have been more than enough but I cant and wont be accused of a FELONY I know Im not guilty of. Battery makes it sound like I intentionally did harm to an officer while in handcuffs. Im not a violent person when sober or even drunk, and have no misdemeanor or felony adult record to prove that. And please dont reply if youre going to tell me I shouldnt be drinking and how dumb i was acting. I have some good times with friends at parties occasionally but Im not a drunk and dont really like drinking. The only mistake I made was drinking too much, everything else was out of my control. I guess it was the type of liquor I was drinking that made me act this way idk but Ive NEVER acted out like this no matter how drunk Ive gotten in the past. I learned my lesson and dont mess with the hard liquor anymore and thats what really matters. The question is, based on what I did and didnt do, do you think the state has a case? Do you think theyll stick in court based on the report and my history? I need some advice on what to do to get these dropped, not criticism Im pleading NOT GUILTY btw, thx ;)
Answer: Most of what nomad said I agree with except the part where he said you "hit" your sister and she has the right to use unreasonable means to move you. It did not say that in the report nomad, maybe you should check your eyes. She doesn't have any right to move you or even touch you unless you put your hands on her first even if she owns the place unless of course you don't live there and I think that's what he thought. She "moved" him which is the same as pushing him, or anything else in the laws eyes, which would then give him the right to push or "shove" her back, which it says he did, in self defense. What she should have done was stayed out of your way until the cops got there and let them handle it although I don't blame her for doing what she did. Instead she chose to instigate the whole thing further by pushing or "moving" an already drunk, irrational, and incoherent person to the door which stirred things up even more. And she has no right to kick you out of the house if her name isn't on the lease. In most states, she has to go through the courts the legal way and serve you an eviction notice which would then give you 30 days to move out, and that's if she owned the house, but you say she doesn't even pay rent. I don't know what state you live in du nomad, but I never want to live there. Michael, you said she isn't pressing charges so none of that matters anyway unless the state picks it up, and trust me, with your clean history, they won't bother with that minor incident. They'll drop the felony too and you'll prob get off with only the resisting without.
I'm sure these guys haven't been that drunk but I know I have and I know exactly how you feel and what you're going through. I was in the almost exact situation once. Everything was out of your control. You basically just woke up in jail. It happens which is why you have to be responsible with your liquor. You could have killed someone and wouldn't even know it!

Can i still press charges against him?
A little over a month ago when i was 7 and 1/2 months pregnant i was pushed against closet doors, thrown on the ground and punched in the face once and then when mi stood up to call the cops i was punched twice more, the last punch making me blak out and fall to the floor. Im 20 and the person who attacked me, my adoptive brother is 22. His court date was two days ago and i think he might only have probation for 30 days or something. Im not even sure about that because no one ever called me to tell me anything. I think the state pressed charges. The police didnt ask me if i wanted to press charges. All the did was take pictures of my injurys and tell me to write down my statement which i couldnt do beause i couldnt see clearly and was confused. Can i still press charges against him? if not, can i sue him? He has chosen to put a girl (she encouraged him to hit me) before the family and has not shown any remorse. I feel like he isnt being punished. This is the 2nd time he got away with assulting me. If he did it twice and got away with it, he probably thinks he can do it again. Its not okay
Answer: First of all you can and should get a restraining order against him so that he cannot contact you or assault you again. If he does he goes to jail just for that.
Second if he was not tried or plead yet you should be able to find out and see if you can testify or object to a plea bargain, etc. See if your county has a victim's assistance program/
Thrid you absolutely can sue him for your injuries, medical costs, pain and suffering. It sounds to me like at least $5000 worth of damage.Probably more.

Helping my little brother out of his abusive relationship but he doesnt want to testify..?
Three nights ago i was talking to my little brother who is 22 and is married to a 35 year old lady. His wife is controlling abusive to him and has tried to kidnap my brother when he was a 15 year old. My parents nor i knew nothing about there relationship till he brought her home when he was 18 and told us all he was getting married to this chick we all knew it was bad news from the get go but we couldnt change his mind at all. Well he came over the other day crying and told me his wife has been beating on him with a baseball bat and that she told him if he leaves her that she will kill him and that he wants to get out but has no place to go and that he is scared. He has been staying here with me and my husband and our two year old son. Well today we got a cop to go with us and got a lot of his stuff and the cops arrested her for Domestic abuse and Statutory Rape. Well my brother has all these bruises and has some broken ribs from where this chick beat him and i am not sure what to do from here. I dont mind him staying here for a little bit but i also want him to get back onto his own to feet as fast as possible without being mean or anything. And he told me today he doesnt want to testifiy against her if they need him to or whatever because he is scared. Advice?
Answer: Your brother is scared, as most domestic violence victims are. You need to get him some counseling fast. And you need to explain to him quite clearly that he must testify in court because if he does not, his wife will be set free and she will be able to continue to abuse him. But if he does testify, then his testimony and those bruises and broken ribs will get her put in prison where she belongs. And that will keep him safe.
I know you want him to get back on his feet as fast as possible but your time frame and his are probably quite different. When you have been physically and emotionally abused, you become damaged inside and you become afraid. You can't overcome this in just one night or even in a month. And unless you have been abused, you just won't understand how sapping this can be to one's self-esteem. And if you push him too fast, he will collapse and may end up returning to his abuser.
This is what you need to do. Start by contacting a victim's services (the police should know if there is one available) and also contact the local woman's shelter to see if they know if there are any domestic violence resources for men in your community. Also contact the National Domestic Violence Hotline for support. You can find them here: http://www.thehotline.org/ Unfortunately, most resources are for women but there are some for men.
And then you need to back off on pushing your brother to get back on his feet. The best he can do right now is to testify and if necessary, you need to push him into doing so...so he can be safe. Since you aren't prepared to take your brother in on a long term basis, you need to find a men's shelter or some sort of sheltered accommodation in which he can live while he regains his self-esteem and sense of self-worth through extensive therapy. He may need to go on welfare too and a lawyer should be retained who can sue his wife for all her assets for abusing her husband (a criminal conviction for abuse is needed first).

Can my brother appeal his plea bargain?!?
My brother signed a plea bargain because his lawyer pushed him into it, hes being accused of raping his 11 year old step daughter. She was 10 at the time. There is absolutely NO evidence that anything ever took place. Here is the article from the Sentinel that was in today...
LEWISTOWN - A jury trial for a Lewistown man charged with raping a 10-year-old girl was called off Monday after the defendant recently pleaded no contest to two of the seven charges filed against him.
Jack C. Wakefield Jr., 30, pleaded no contest to rape of a child and involuntary deviate sexual intercourse, and was sentenced by President Judge Timothy S. Searer to serve eight to 16 years in a state correctional facility. Wakefield also is required to register under Megans Law for the rest of his life. The remaining related charges filed against Wakefield were dismissed.
Although the no contest plea is not an admission of guilt, for sentencing purposes it is the same as having pleaded guilty to the charges.
Mifflin County District Attorney Steve Snook said he would only agree to the plea arrangement hashed out with Wakefields attorney Dave Smith if the defendant was immediately sentenced by Searer thereafter.
Snook said his experience as a prosecutor over the years led him to believe Wakefield may withdraw his plea if the sentencing date were pushed back to another date.
Snook said this suspicion that the defendant would try to withdraw his plea became even more likely after Wakefield spent nearly an hour deciding if he wanted to plead no contest to the charges.
"The worst thing for a victim is if the defendant enters a plea and then withdraws it," Snook said of the emotional impact that sexual assault victims feel when they are compelled to testify against their attacker during a trial.
In past court appearances, Smith said he had reason to believe the victim in this case named someone else as the perpetrator.
Smith had filed a motion to review Children and Youth Services records relevant to this case and Searer granted the motion in part; however, it remains unclear what if anything in those files may have aided in Wakefields defense.
Smith said the case came down to a credibility issue with the juvenile and he believed the jury could have convicted his client on all the counts based on her testimony, even though there was no physical evidence implicating his client nor was there any kind of confession made.
In Pennsylvania, a jury can convict someone of a sexual assault crime if they find the alleged victims testimony to be credible.
"It was a very difficult case, these types of cases always are," Smith said.
Wakefields charges stem from repeated assaults on the juvenile that started in December 2004.
Police said they first became aware of the allegations from school personnel at an elementary school in Mifflin County.
According to court documents, a school official was informed by another juvenile, whom the alleged victim had confided in.
After school officials spoke with the alleged victim, police and Children and Youth Services were notified and charges were subsequently filed against Wakefield.
Pending further court action, Wakefield remains incarcerated at the Mifflin County Correctional Facility awaiting transfer to a state prison.
Please let me know if he can appeal the Plea Bargain n if u would or not! He only has 6 days left to appeal if he can. Its my understanding that u only have 10 days to appeal.
